These Terms and Conditions govern access to and use of the Birdies Indoor Golf website, booking application, facilities, online store, and related services.

Birdies Indoor Golf Inc. is the parent company and the seller for all purchases made through the Birdies online store. Bookings and facility services are provided by the company operating the applicable location:

• Mississauga: Birdies Mississauga Inc.
• Oakville: Birdies Oakville Inc.
• Burlington: Birdies Burlington Inc.

Your agreement for a booking or facility service is with the applicable location operator. Your agreement for an online store purchase is with Birdies Indoor Golf Inc.

In these Terms, “Birdies,” “we,” “us,” and “our” refer to the applicable company providing the service or selling the product.

By accessing https://www.birdiesindoorgolf.ca, you agree to abide by these Terms and Conditions and to comply with all applicable laws and regulations. If you do not agree with these Terms and Conditions, you are prohibited from using or accessing this website or using any other services provided by BIRDIES INDOOR GOLF.

We may update these Terms and Conditions from time to time. Revised Terms will be published on this page with an updated effective date and will apply to bookings and purchases made on or after that date.

Existing bookings and purchases remain subject to the Terms accepted at the time of the transaction, unless a change is required by applicable law or expressly agreed to by the customer. Where required by law, we will provide notice of changes and obtain consent.

Use of our Site​

You agree to use our website for legitimate purposes and not for any illegal or unauthorized purpose, including without limitation, in violation of any intellectual property or privacy law. By agreeing to the Terms, you represent and warrant that you are at least the age of majority in your state or province of residence and are legally capable of entering into a binding contract.

You agree to not use our Site to conduct any activity that would constitute a civil or criminal offence or violate any law. You agree not to attempt to interfere with our Site’s network or security features or to gain unauthorized access to our systems.

You agree to provide us with accurate personal information, such as your email address, mailing address and other contact details in order to complete your order or contact you as needed. You agree to promptly update your account and information. You authorize us to collect and use this information to contact you in accordance with our Privacy Policy.

Limitations of Use​

• By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

• modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;

• remove any copyright or other proprietary notations from any materials and software on this website;

• transfer the materials to another person or “mirror” the materials on any other server;

• knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service BIRDIES INDOOR GOLF provides;

• use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;

• use this website or its associated services in violation of any applicable laws or regulations;

• use this website in conjunction with sending unauthorized advertising or spam;

• harvest, collect, or gather user data without the user’s consent; or

• use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.​

Intellectual Property​

The intellectual property in the materials contained in this website are owned by or licensed to BIRDIES INDOOR GOLF and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.

This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms and Conditions, and may be terminated by BIRDIES INDOOR GOLF at any time.

User-Generated Content​

You retain your intellectual property ownership rights over content you submit to us for publication on our website. We will never claim ownership of your content, but we do require a license from you in order to use it.

When you use our website or its associated services to post, upload, share, or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, run, copy, publicly display, translate, or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.

The license you grant us can be terminated at any time by deleting your content or account. However, to the extent that we (or our partners) have used your content in connection with commercial or sponsored content, the license will continue until the relevant commercial or post has been discontinued by us.

You give us permission to use your username and other identifying information associated with your account in a manner that is consistent with your privacy preferences, and our Privacy Policy.

Liability​

Use of our facilities and equipment involves risks, including being struck by golf clubs or balls, slips and falls, and injuries arising from physical activity. All participants must follow posted safety instructions, remain clear of another player’s swing area, and use equipment only as intended.

Participation is subject to our separate Release and Waiver of Liability, which each adult participant must review and accept before participating. The waiver contains important provisions concerning assumption of risk, release of claims, and indemnity. Acceptance by a booking holder does not replace acceptance by other adult participants.

Nothing in these Terms excludes or limits any rights, remedies, or liability that cannot lawfully be excluded or limited.

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, BIRDIES INDOOR GOLF makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall BIRDIES INDOOR GOLF or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if BIRDIES INDOOR GOLF or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity, or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.​

Accuracy of Materials​

The materials appearing on our website are not comprehensive and are for general information purposes only. BIRDIES INDOOR GOLF does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.

Products or Services​

All purchases through our Site are subject to product availability. We may, in our sole discretion, limit or cancel the quantities offered on our Site or limit the sales of our products or services to any person, household, geographic region or jurisdiction.

 

Prices may change for future bookings and purchases. A price change does not alter the price of an existing confirmed booking or completed purchase unless you agree otherwise. All prices are quoted in Canadian dollars. Applicable taxes and mandatory charges will be disclosed before checkout.

 

We reserve the right, in our sole discretion, to refuse orders. If we believe that you have made a false or fraudulent order, we will be entitled to cancel the order and inform the relevant authorities.​

Cancellation Policy & Fair Use Policy​

Bookings must be cancelled through app.birdiesindoorgolf.ca. Cancellation eligibility is determined by the time the cancellation is successfully completed relative to the scheduled booking start time. Cancellations made at least 24 hours before the booking start time are eligible for a refund to the original payment method, less a 3% administration fee on the amount refunded, except where prohibited by law. Cancellations made at least 3 hours but less than 24 hours before the booking start time are eligible for account credit only, with no cash refund. Cancellations made less than 3 hours before the booking start time, and no-shows, are not eligible for a refund or account credit. Account credits are not redeemable for cash, except where required by law. Birdies may waive the administration fee at its discretion. The Fair Use Policy limits customers to 5 cancelled bookings in any rolling 30-day period. Cancellations exceeding this limit are not permitted under this policy. Birdies may restrict cancellation privileges or refuse future bookings where this policy is abused, subject to applicable law.

Payments/Credit Card​

All bookings require a valid credit card. Your card will be charged immediately upon successful booking. No credit card information is stored with us. Bookings are completed on a third party booking platform. We are not responsible for the Privacy Policy or Terms and Conditions of these third party websites. Refunds and cancellations are governed by the applicable cancellation policy or product terms. Nothing in these Terms limits any refund or cancellation rights available under applicable law. Customer-requested credit card refunds are subject to a 3% administration fee on the amount refunded, except where prohibited by law. Birdies may waive this fee at its discretion.

Booking End Time & Overtime Charges

All players must stop playing and fully vacate their bay by the scheduled booking end time. If you or your guests occupy the bay beyond that time without a confirmed booking extension, overtime will automatically be charged to the credit card used for the booking at the regular hourly rate for the applicable bay and time period, plus applicable taxes. Overtime is billed in 15-minute increments, rounded up: each started 15-minute increment is charged at one-quarter of the regular hourly rate. For example, at a regular hourly rate of $18 plus tax, each 15-minute increment costs $4.50 plus tax. By completing a booking, you authorize Birdies to charge your card for these amounts. Overtime charges do not guarantee additional playing time or permission to delay the next booking.

Damage & Missing Equipment

The booking holder is responsible for damage to the facility or equipment, and for missing items, caused by the booking holder or their guests. This includes damage caused by misuse, vandalism, use of prohibited personal golf balls, tampering with cameras or equipment, or unauthorized changes to computer software or settings. Ordinary wear and tear is excluded. Birdies may charge the credit card used for the booking for reasonable, documented repair or replacement costs, taking account of the condition of the affected item and avoiding unnecessary upgrades. By completing a booking, you authorize these charges. Birdies will provide an itemized explanation and supporting information on request. No separate minimum damage fee applies.

Facility Rules and Regulations​

The booking holder must ensure that their guests follow these facility rules and the posted safety instructions. Charges for damage, missing items, excessive cleaning, alcohol-related cleaning, and overtime are governed by the specific provisions in these Terms. Facility rules include the following:

No Alcohol, smoking, or vaping.

No loud music.

No food or drink waste to be left in the bays upon completion of booking.

Excessive Cleaning: Players must leave their bay tidy, place waste in the bins provided, and remove personal belongings. Where a booking holder or their guests leave spills, stains, excessive rubbish, mud, or other mess requiring cleaning beyond routine turnover, a minimum cleaning and administration fee of $100 CAD applies. This fee covers arranging and coordinating the cleanup, incident documentation, and cleaning services. Where reasonable, documented cleaning and administration costs exceed $100, the total charge may reflect those higher costs.

Alcohol-Related Cleaning: Alcohol consumption is prohibited on the premises. If the booking holder or their guests consume alcohol in a bay, Birdies will arrange additional cleaning to remove alcohol-related waste and residue, wipe affected surfaces, and address spills or odours. A minimum cleaning and administration fee of $100 CAD applies when this additional cleaning is arranged. This fee covers arranging and coordinating the cleanup, incident documentation, and cleaning services. Where reasonable, documented cleaning and administration costs exceed $100, the total charge may reflect those higher costs.

Racism, profanity, or loud and disruptive behavior that negatively impacts other guests.

Misuse, abuse, and or improper use of the computers other than for the sole purpose using the simulator software.

Birdies operates as a self-service facility. The booking holder is responsible for their guests and for leaving the bay in a tidy condition. By completing a booking, you authorize Birdies to charge the credit card used for the booking for the cleaning and administration charges described above. Birdies will provide an itemized explanation of any additional charge and supporting information on request. Questions or disputed charges may be directed to info@birdiesindoorgolf.ca. Breaches of facility rules may result in the session being ended without refund or in suspension of future access, subject to applicable law. No unspecified general rule-violation fee applies, and the same loss or cleaning work will not be charged twice.

Right to Terminate​

We may suspend or terminate your right to use our website and terminate these Terms and Conditions immediately upon written notice to you for any breach of these Terms and Conditions.​

Severance​

Any term of these Terms and Conditions which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms and Conditions is not affected.

Governing Law​

These Terms and Conditions are governed by and construed in accordance with the laws of Canada. Any disputes arising out of or relating to the Terms, the Privacy Policy, use of our website, or our products or services offered on our Site will be resolved in accordance with the laws of the Province of Ontario without regard to its conflict of law rules. Any disputes, actions or proceedings relating to the Terms or your access to or use of our Site must be brought before the courts of the Province of Ontario in the City of Mississauga, and you irrevocably consent to the exclusive jurisdiction and venue of such courts.
